A Step Closer to Exacting Punishment on Madoff 'Accomplices'

The SEC filed an amended complaint against Cohmad Securities Corp., et al and, on that same day, the parties submitted to presiding Judge Stanton partial judgments on consent.  If approved by the Court, defendants Robert Jaffe, Maurice Cohn, Marcia Cohn and Cohmad Securities Corp. will be permanently enjoined from future violations of certain provisions of the federal securities laws. 

The amended complaint alleges the defendants made material misrepresentations and omissions by referring hundreds of investors to "Bernie Madoff & Co," while they were aware of and failed to disclose facts that should have raised serious questions about the propriety of the Madoff investment.  All told, clients of the three invested over a billion dollars with Bernie. 

Each partial judgment provides that the issue of disgorgement, prejudgment interest and civil penalty relief against the defendants will be decided at a later time.  In the meantime, they agree not to violate specific laws.  [SEC Litigation Rel. 21718, 11/1]
