Account Type Indicators: Revised List

October 10, 2012

[ by Howard Haykin ]

New List begins 10/15/12;  however, Members get 3-month transition period.

The NYSE and NYSE MKT LLC (fka the Amex) have eliminated certain equities Account Type Indicators ("ATI") that are obsolete.  Beginning 10/15/12, members will no longer be required to use the eliminated ATIs.

  • Members, however, may continue to use the eliminated ATIs - up to and including trade date 2/1/13.
  • On 2/2/13 and thereafter, members must cease using the eliminated ATIs and must use the ATIs in Attachment A of the Information Memo.

Background. Exchange Rule 132.30(9) requires that all orders submitted to the Exchange include specified trade data elements, including "[w]hether the account for which the order was executed was that of a member or member organization or of a non-member or non-member organization."  The Exchange has, over the years, published guidance on which ATIs satisfy this requirement.

But the Exchange reviewed existing ATIs and determined that several categories of ATIs no longer serve their original, primarily regulatory, purpose.  By eliminating these ATIs, and related definitions, the Exchange will both simplify the reporting obligations of member obligations and re-focus the audit trail information in a manner that will be more useful to NYSE Regulation and FINRA.

Impact on OATS Reporting. In certain instances, the information that member firms must report to OATS, as required under Exchange 7400 Rule series, may appear inconsistent with the ATIs member organizations must report pursuant to Exchange Rule 132 and this Information Memo.  Refer to a clarifying guide to these instances is outlined in Attachment C.

NYSE Staff Contacts. Direct questions  to the appropriate individuals: Re: Operations regarding ATIs: Bob Airo, SVP, NYSE Operations, 212.656.5663.  Re: NYSE & NYSE Amex Equities Rules and ATI requirements: Clare Saperstein, VP, NYSE-Reg:  212.656.2355; or David De Gregorio, Chief Counsel, NYSE-Reg: 212.656.4166.
