BofA Wins Another Court Decision

Judge Arthur Anderson - no relation to the demised accounting firm - ruled in favor of Bank of America in a consumer fraud case initiated by the state of Arizona.  The Superior Court judge denied AZ's Attorney General, who sought permission to interview former BofA call center employees privately - i.e., without bank attorneys being present. 

The former call center employees are key to the state's case because they dealt firsthand with mortgage borrowers.  Of course, Arizona may still interview the employees, but only in the presence of BofA attorneys. 

Arizona had argued that BofA would likely interfere with the interviews because the bank had hindered a federal investigation into its foreclosure practices.  BofA denied that statement, noting that it had cooperated with the federal inquiry and that a ruling in its favor simply would affirm its right to having counsel present during interviews.    [Bloomberg, 8/12/11]
