Falcone's Wife Charged with 'DWI'
September 5, 2012
[ by Melanie Gretchen ]
Phil Falcone is not new to charges, after the SEC in June accused him of (i) misappropriation of client assets, (ii) market manipulation, (iii) betraying clients. This time, however, the accusations were directed at his wife, who is charged with 'driving while ability impaired' after smashing her car in the Hamptons, authorities said yesterday. [See our What Went Wrong story, "Phil Falcone, Harbinger Charged By SEC With Securities Fraud".]
At the Scene. Lisa Marie Falcone, 48, was leaving Hampton Classic horse show when she turned her Mercedes SUV from Montauk Highway onto Hayground Road in Bridgehampton and rear ended another Mercedes before smashing into a parked Verizon van. Verizon worker Fred Lederman called the police, ignoring her pleas, to him and the owner of the Mercedes she hit, that "her husband would pay for everything," according to an eyewitness.
Minutes later, Phil Falcone himself arrived at the scene, where he shouted at the cops not to tow her car, but to wait for an official Mercedes dealer, the witness said. His yelling prompted a Southampton Town cop to order the billionaire to the side of the road and called for backup. As the offer asked her to take a Breathalyzer, her husband yelled "Don’t take it! Don’t take it!"’.
What Happened. In her defense, Lisa Falcone told cops she was speeding to escape someone who was chasing her, the police report said. Court papers say she claimed she doesn’t drink but had a lemonade at the event that could have been spiked.
Once the officer threatened to arrest her because of the refusal, he change his tune to say, "Take it! Take it!". At the scene, she blew the Breathalyzer with a .06, at the scene, beneath the legal limit of .08; at the local stationhouse, took another Breathalyzer read .03. With her blood test result pending, she admitted popping Benadryl, an anti-allergy drug, and neurontin for pain, according to the papers.
Does It Still Pay to Be Falcone? Despite all the damage and all the commotion and all the legal woe surrounding her family, Lisa Falcone didn't spent the night in jail. Four hours after her arrest, she was granted release on a desk appearance ticket that evening and arraigned the following morning, where she pleaded not guilty to the violation, according to police.
