Madoff Family Members: Risk of Clawbacks

It should come as no surprise that members of the extended (Bernie) Madoff clan have no interest in cooperating with trustee Irving Picard's efforts to seize their assets. Mr. Picard argues that money they received from Bernie Madoff & Co. should be clawed back and added to the distribution pool for Ponzi scheme victims. To date, $11.5 billion of the $17.5 billion stolen has been recovered.
Last June, Peter Madoff pled guilty to criminal charges including conspiracy to commit securities fraud and making false filings with the SEC; in January, he was sentenced to 10 years in a pleas deal with federal prosecutors. However, the $4.6 million that federal authorities got for Mr. Madoff's luxury property on Park Avenue doesn't even scratch the surface of what Mr. Picard seeks to recover.
Here's the Madoff Family Member Clawback Scorecard with the amount each owes, according to trustee Picard:
- Ruth Madoff (Bernie's wife): $44.8 million
- Peter Madoff (brother): $90.4 million
- Shana Madoff (niece): $15.3 million
- Estate of Mark Madoff (son) who committed suicide: $81.3 million
- Susan Elkin (Mark's first wife): $2.4 million
- Stephanie Mack (Mark's widow): $27.5 million and property of undetermined value
- Andrew Madoff (son): $73.8 million
- Deborah Madoff (Andrew's wife): $27.7 million
The total exceeds $300 million.
