OWS Protesters Face Downtown Legal Team
November 22, 2011
The Downtown Community Coalition, consisting of lower Manhattan residents and businesses, has countered a lawsuit filed by Occupy Wall Street protesters by arming itself with a "hired legal gun" - Randy Mastro of Gibson, Dunn & Crutcher.
The protestors are seeking the right to continue camping out in Zuccotti Park. Mr. Mastro, co-chairs his firm's litigation department and has significant experience in NYC politics - having served in Rudy Giuliani's mayoral administration from 1994 to 1998, including a stint as deputy mayor of operations.
Just last week, NYS Supreme Court Justice Michael Stallman ruled against allowing the protesters to continue camping in Zuccotti Park, but Occupy's underlying case is focused on First Amendment claims.
Mr. Mastro has hit the ground running, issuing a memo in support of its motion to intervene, contending that protesters have committed "unspeakable horrors" - including "urination, defecation and fornication." Mr. Mastro, who's done work for the coalition before, is charging out his services at a discount.
OWS Counsel. Yetta Kurland, who's representing the protesters, said she had not yet seen all the coalition's court documents and has not decided whether to oppose the intervention. She added that the downtown coalition probably would not be able to introduce any new information to the case, beyond that which the City and park owner Brookfield Properties have already brought forward.
